SIVABALAN SANKARAN was admitted as an Advocate and Solicitor of the High Court of Malaya in 1989 and has been in practice since then in Brunei and Malaysia.

He is a highly regarded senior contracts, commercial and litigation lawyer and in his early practice, was a highly-experienced insurance lawyer having been retained by major insurance companies for a variety of matters involving areas of insurance including marine, damage claims, fire and general insurance matters. He has also represented insurance companies from Singapore, Brunei, Malaysia and Netherlands in the drafting of policies, and advice on corporate restructuring, mergers and more.

He worked with international counsel on numerous arbitrations including construction and international commercial contract-related arbitration and is now focused on the Construction sector in Malaysia.

He represents multinational clients in a wide range litigious and non-litigious matters including building contracts and construction disputes, land disputes, and landlord and tenant matters. He is well-versed with banking and finance litigation, defamation and commercial disputes.

Mr Sankaran was listed in Chambers for Business law in Brunei and is a visiting tutor at the Southwestern University of Politics and Law in Chongqing, China.

TAN SWEE IM was called to the Bar as a Barrister-at-Law from the Middle Temple in 1987 and admitted as an Advocate and Solicitor of the High Court of Malaya in 1988.

She completed her pupilage with Messrs Shook Lin & Bok and practiced with them. Thereafter she spent 3 years as in-house counsel for the YTL Group, followed by Messrs Abu Talib Sharom and Zahari and Messrs David Chong & Co. In 1999 she started her own firm, Messrs Tan Swee Im & Co. and in  2006 merged with Messrs P.Y. Hoh & Tai to form Messrs Tan Swee Im, P.Y. Hoh & Tai. Since 2015 the firm is known as Tan Swee Im, Siva & Partners. Her main focus is on construction industry and privatisation matters. Recognised by Who’s Who Legal as 1 of only 5 leading construction lawyers in Malaysia.

Her active involvement in major projects include KL International Airport, Malaysia-Singapore Second Crossing, Independent Power Plants at Pasir Gudang and Paka, 10,000 Units Teachers Housing Quarters, KL Sentral, Sg Prai Bridge, Pochentong International Airport Cambodia.

She is a Fellow of the Chartered Institute of Arbitrators, a Fellow of the Malaysian Institute of Arbitrators, a Fellow of the Chartered Institute of Building, a Fellow of the Malaysian Society of Adjudicators, a Fellow of the Dispute Board Federation, an arbitrator, adjudicator and mediator on the panel of Kuala Lumpur Regional Centre for Arbitration, a qualified adjudicator, a CIDB Accredited Mediator, and holds a Diploma in International Commercial Arbitration. As an active contributor to the Master Builders Association of Malaysia she was actively involved in the drafting of the CIDB Form of Contract for Building Works and led the drafting on the new standard form of design and build contract promoted by the CIDB.

She and her team prepared the Working Guide, Standard Forms and Checklists on the adjudication process under the Construction Industry Payment And Adjudication Act 2012 (CIPAA) published by the Construction Industry Development Board (CIDB) to assist parties to make and defend payment claims under CIPAA.

 

 

WONG HAI WAI

WONG HAI WAI was called to the Malaysian Bar in 1986 and has been in practice since then specialising in trial court experience including appellate work. He completed his pupilage with Messrs Manjit Singh Sachet, Mohammad Radii & Partners and thereafter joined the firm of Messrs Megat Najmuddin Leong & Partners.

In 1989 he joined Messrs T. H. Su & Co and he was the partner in-charge of litigation department. The main areas of his work are in banking recovery work, insolvency, co-operative societies and construction disputes and arbitration.

He set up his own firm of Messrs Wong Hai Wai & Associates in 1997 specialising in drafting contracts, construction disputes and contract management. The main areas of his work center on construction disputes and arbitrations with the collorary action in court for applications for injunctions against calls for guarantees and performance bonds, applications for leave to enforce arbitral awards, applications to set aside arbitral awards, applications to stay court proceedings, applications to remove arbitrators.

In 2009 he joined Messrs Tan Swee Im, P.Y. Hoh & Tai [now known as Messrs Tan Swee Im, Siva & Partners] as a consultant.

LIM CZE MIEN

LIM CZE MIEN was admitted as an Advocate and Solicitor of the High Court of Malaya in 1999 and has been in practice since then.

Having completed her pupilage at Messrs Kamarudin & Partners, she stayed on as a legal assistant handling corporate and conveyancing matters including handling the issue of Islamic Bonds, a housing development project and a major bank’s housing loan campaign portfolio.

She then joined Messrs Chooi & Company where she practiced for over 10 years in the Corporate and Financial Services Department. Her work included large scale securitisation, debt restructuring, mergers & acquisitions and advising top-tier foreign banks on offering of financial products (including commodity derivatives) and services. She was a partner of the firm at the time of leaving Messrs Chooi & Company.

She joined Messrs Tan Swee Im, P.Y. Hoh & Tai in July 2012 where she undertakes general corporate commercial work as well as drafting and advisory on constructin industry matters. In addition, she advises local and foreign companies on risk management under oil and gas, and local standard form contracts, and was involved in the preparation of bid documents for a high-profile development project to build an international financial and economic hub.

THARMINI PARAMASIVAN

THARMINI PARAMASIVAN was admitted as an Advocate and Solicitor of the High Court of Malaya in 2011 and has been in practice since then.

She completed her pupilage at Messrs Jasbeer, Nur & Lee. She was exposed to various general litigation matters including but not limited to patent disputes, goods sold delivered and land disputes.

She then joined Messrs Ching Ling Hau & Partners and continued her practice in general litigation whereby she has appeared on behalf of individuals and companies on land disputes involving unlawful land encroachments and debt recovery.

She joined Messrs Ong Kok Bin & Co in 2013. She has appeared in the High Court and Lower Courts representing banking institutions, companies and private individuals. She has assisted in preparing for trial and appeals before the Appeal Courts in relation to a general disputes and corporate disputes. She has gained experience in banking litigation, debt recovery and execution proceedings (bankruptcy, winding up proceedings, public auctions, seizure and sale, judgement debtor summons). She has gained experience in handling the sale and purchase of properties with and without titles and in this respect drafts and vets Sale and Purchase Agreements and Deeds of Assignments and other related documents. She then continued her practice with Messrs Lai & Associates before joining Messrs Tan Swee Im, Siva & Partners in December 2015.

She is assisting the partners in arbitration, adjudication and litigation matters related to construction industry. She has gained considerable knowledge on CIPAA since she joined Messrs Tan Swee Im, Siva & Partners.

 

 

SHAUN TAN CHENG HONG

Shaun Tan was called to the Bar of England & Wales as a Barrister-at-law from The Honourable Society of the Inner Temple in 2014. Shaun became an accredited Mediator by the ADR Group in the United Kingdom and in America by the International Academy of Dispute Resolution in 2014. He also completed the Diploma in International Commercial Arbitration course held by the Chartered Institute of Arbitrators in 2014. Subsequently he commenced his pupillage at the general litigation department of Messrs Chooi & Company.

During his pupillage he was exposed to a wide range of commercial, banking, construction and tortious disputes. Upon completion of his pupillage he was admitted as an Advocate & Solicitor in 2015. Thereafter he joined Messrs James Monteiro a law firm specialising in Construction law, there he was involved in numerous adjudication proceeedings pursuant to CIPAA 2012. Subsequently, he joined Messrs Tan Swee Im, Siva & Partners and has been involved in various adjudication and arbitration proceedings in the construction industry.

 

 

 

 

 

LEEM LAY GIAN

LEEM LAY GIAN was admitted as an Advocate and Solicitor of the High Court of Malaya in 2008 and has been in practice since then.  

She joined Messrs C. L. Boo & Associates, Batu Pahat in 2008 and was assigned to conduct general civil litigation matters such as foreclosure proceedings, bankruptcy proceedings, joint or unilateral divorce petition, petition for Grant of Probate / Grant of Letters of Administration, Small Estate Distribution applications, claims for goods sold and delivered to name but a few. She also handled conveyancing matters. 

Subsequently, in August 2011, Ms. Leem joined Messrs Wang & S. B. Wong, specialising in all sorts of conveyancing practice including sale and sub-sale of properties, land dealing, commercial and corporate loan, perfection of transfer and charge, preparation of tenancy agreements, will writing and more. She was involved in some renowned development projects namely Country Garden, Danga Bay; Tropez Residences, Danga Bay; Bora Residences, Danga Bay; KSL Residences, Taman Century; Twin Galaxy Residences, Jalan Dato Abdullah Tahir; and Seasons Apartment, Larkin all of which are located in Johor Bahru.

At the same time, she has been assigned to handle loans from following banks such as Alliance Bank (Malaysia) Berhad / Alliance Islamic Bank Berhad, Ambank (M) Berhad, Bank of China, CIMB Bank Berhad / CIMB Islamic Bank Berhad, Hong Leong Bank Berhad / Hong Leong Islamic Bank Berhad, Malayan Banking Berhad / Maybank Islamic Berhad, Malaysia Building Society Berhad, OCBC Bank (Malaysia) Berhad / OCBC Al-Amin Bank Berhad, Public Bank Berhad / Public Islamic Bank Berhad, RHB Bank Berhad, Standard Chartered Bank Berhad, and United Overseas Bank (Malaysia) Berhad .

She then continued her practice with Messrs Tan Vincent & Azmi before joining Messrs Tan Swee Im, Siva & Partners in February 2017.
